This right will continue to apply after termination, cancellation or amendment of these terms and conditions.
13.2.3 You agree that the owner is entitled, but is not obliged, to institute any proceedings arising out of or in connection with these terms and conditions or your use of the website or of the website content, in any magistrate’s court in the Republic of South Africa having jurisdiction over you, even though the cause of action in question exceeds the jurisdiction of that court.
13.2.4 Neither you nor the owner will be precluded from obtaining interim relief on an urgent basis from a court of competent jurisdiction pending the institution or resolution of a dispute or other legal proceedings.

13.5.5 In the event that any of the terms of these terms and conditions are found to be invalid, unlawful or unenforceable, such terms will be severable from the remaining terms, which will continue to be valid and enforceable.
13.5.6 References to “writing” or notices “in writing” by the owner in these terms and conditions only includes writing on paper signed in ink by an authorised representative of the owner and specifically excludes any writing that may be in electronic form.
13.5.7 No relaxation or indulgence that the owner may grant to you will be deemed to be a waiver of any of the owner’s rights in these terms and conditions or in law.
13.5.8 In the event of any conflict between these terms and conditions and any additional terms and conditions, the additional terms and conditions will prevail.
13.5.9 The termination of the agreement created by these terms and conditions will be without prejudice to any other rights or remedies that you or the owner may be entitled to under this agreement or at law, and will not affect any accrued rights or liabilities of you or the owner nor the coming into or continuance in force of any provision of these terms and conditions that is expressly or by implication intended to come into or continue in force on or after such termination.
14. SA Home Owner competitions
14.1 Competition Entrants will be deemed to have accepted these rules and agree to be bound by them when entering SA Home Owner Competitions.
14.2 Participation in a Competition and any prizes redeemed are subject to these Terms and Conditions, which will be interpreted by Arena Holdings in its sole and absolute discretion.
14.3 The first correct entry drawn after the closing date will win the prize/s.
14.4 The judges’ decision is final and no correspondence will be entered into.
14.5 The winner/s will be notified telephonically and/or via email or SMS as per the details provided.
14.6 To comply with the Consumer Protection Act, winner/s will be required to supply their ID numbers.
14.7 If a selected winner cannot be reached at the contact details supplied, an alternative winner will be selected.
14.8 The winners are required to accept the prizes as described in SA Home Owner. No correspondence will be entered into relating to the terms on which the prizes are offered.
14.9 Employees of Arena Holdings and the prize-sponsoring companies, their family members, advertising and promotion agencies and any other parties associated with a Competition, may not enter.
14.10 The Entrant’s privacy is very important to Arena Holdings and it will use reasonable efforts in order to ensure that any information, including personal information, provided by the Entrant, or which is collected from the Entrant, is stored in a secure manner.
14.11 The Entrant agrees to give (where applicable) honest, accurate and current information about the Entrant to Arena Holdings and to maintain and update such information when necessary.
14.12 The Entrant’s personal information collected by Arena Holdings may be used for the following reasons:
14.12.1 Services Purposes – such as providing our services;
14.12.2 Marketing purposes -such as pursuing lawful market related marketing activities,including business intelligence (including website activity and market research);

14.13 The Entrant acknowledges that any information supplied to Arena Holdings is voluntarily.
14.15 By submitting any information to Arena Holdings in any form the Entrant further acknowledges that such conduct constitutes an unconditional, specific and voluntary consent to the processing of such information by Arena Holdings under any applicable law in the manner contemplated above, which consent shall, in the absence of any written objection received from the Entrant, be indefinite and/or for the period otherwise required in terms of any applicable law.
14.16 Unless the Entrant has consented, Arena Holdings will not sell, exchange, transfer, rent or otherwise make available any personal information about the Entrant (such as name, address, email address, telephone or fax number) to other parties and the Entrant indemnifies Arena Holdings from any unintentional disclosures of such information to unauthorized persons.
14.17 Arena Holdings reserves the right to cancel, modify or amend Competitions at any time if deemed necessary.
14.18 Winners will not be eligible for other prizes for six months after winning a competition.
14.19 The Competitions are only open to persons who are (i) natural persons, (ii) 18 years or older, and (iii) either South African citizens or permanently resident in South Africa.
14.20 Arena Holdings reserves the right to amend these Terms and Conditions at any time, without notice. Arena Holdings will not be required to provide any reasons for any alteration or amendment of these Terms and Conditions, and no person will have any claim whatsoever against Arena Holdings, its associated companies and advertising and promotion agencies.
14.21 Any prizes redeemed pursuant to the Competitions are not transferable and/or negotiable, and cannot be converted to cash.
14.22 In the event of a dispute, the decision of SA Home Owner will be final and binding in all aspects of the Competitions, and no correspondence will be entered into.
14.23 Competition entrants indemnify Arena Holdings, its associated companies, advertising and promotion agencies, and its directors, officers, employees and agents, against any and all claims for any loss or damages, whether direct, indirect, consequential or otherwise, arising from any cause whatsoever in connection with their participation in any of the Competitions.
14.24 All pricing and information is correct at the time of going to print and/or publication.
